GENERAL TERMS AND CONDITIONS OF SALE (GTC)

PURCHASE PROCEDURE

  1. These general terms and conditions of sale ("GTC") govern the offer, transmission, and acceptance of purchase orders for products from ALESSIA FASHION GROUP SRL under the EPIQUE brand, sold on the website www.epique.it.
  2. The seller of the Products, who is a contractual party with the Customer under these general terms and conditions of sale, is ALESSIA FASHION GROUP SRL, trading as EPIQUE, located in TORINO - ITALY, with Tax Code: and VAT: 11653870011.
  3. The products offered for sale by ALESSIA FASHION GROUP SRL are only those available on the www.epique.it website at the time of placing the Order, as described in the respective product information sheets. It is understood, however, that the images accompanying the product description are for informative purposes only and may not perfectly represent its characteristics, but may differ, for example, in color and dimensions (also depending on the browser and monitor used to access the site and view the images).
  4. To place an Order, the Customer must fill out the relevant form on the Website in its entirety and submit it after carefully reviewing the Conditions, as well as the characteristics of the product(s) intended for purchase. The Customer must also request from ALESSIA FASHION GROUP SRL, if desired, the issuance of a tax invoice related to the purchase, in accordance with art. 22 of D.p.R. n. 633/1972.
  5. The correct receipt of the Order is confirmed by ALESSIA FASHION GROUP SRL through an email response sent to the email address provided by the Customer. This confirmation message will briefly recap the purchase conditions, as required by applicable regulations, and the data entered in the Order by the Customer, allowing them to verify and promptly communicate any necessary corrections to erroneous data.
  6. The issuance of a Purchase Order by the Buyer and the corresponding order confirmation by the Seller constitute the conclusion of the contract and the complete, irrevocable, and unconditional acceptance by the Buyer of these General Terms, automatically waiving any of their own general purchasing conditions or standard purchasing contracts. Any agreement deviating from these General Terms will only be effective if explicitly accepted by the Seller in writing.
  7. The commercial services provided are exclusively available to customers defined by law as "Consumers" who have reached the legal age (18 years). "Consumer" means, according to art. 3, paragraph 1, letter a) of the Consumer Code (Legislative Decree September 6, 2005, no. 206 and its recent amendments under Legislative Decree no. 21 of February 21, 2014, in force since June 13, 2014), a natural person acting for purposes outside their commercial, industrial, artisanal, or professional activity.
  8. In the case of customers defined by law as "Professionals," i.e., individuals or legal entities acting in the exercise of their entrepreneurial, commercial, artisanal, or professional activity or their intermediary, as defined in Article 3, paragraph 1, letter c), of the Consumer Code, we kindly ask for the correct and complete provision of all requested information.
  9. ALESSIA FASHION GROUP SRL reserves the right not to accept orders received from Professional customers at its discretion and without the obligation to provide any justification, and not to process orders from customers who do not comply with these online terms and conditions of sale.

OBJECT AND CONCLUSION OF THE CONTRACT

  1. The contract is concluded exclusively through the internet, by the Customer accessing the website www.epique.it, placing an order according to the procedure specified on the site, and its acceptance by ALESSIA FASHION GROUP SRL. The purchase order transmitted by the Customer through the Site is considered a contractual proposal and is governed by these general terms and conditions of sale, which the Customer is required to accept in full and without reservation. To this end, before proceeding to conclude the order, the Customer undertakes to review these GTC and the pre-contractual information provided on the page.
  2. The sales contract is perfected with the sending of an order confirmation email by ALESSIA FASHION GROUP SRL to the Customer. The email contains the Customer's data, the order number, the price of the purchased goods, shipping costs, and the delivery address to which the goods will be sent.
  3. The Customer agrees to verify the accuracy of the personal data contained therein and to promptly communicate any corrections to ALESSIA FASHION GROUP SRL.
  4. In the order confirmation email, the Customer will also receive a link to download and archive a copy of these general terms and conditions of sale, as required by art. 51, paragraph 1 of D.Lgs 206/2005, amended by D.Lgs 21/2014. Additionally, the order confirmation page contains information on the main characteristics and price of each ordered product (including all applicable taxes), the payment method used, delivery conditions, charges for delivery and transport, as well as references to the general terms and conditions for the online return of purchased products.
  5. The order proposal will be archived in our databases for the time required to process your order and subsequently stored, as required by current regulations.
  6. Once the order is registered by ALESSIA FASHION GROUP SRL, it will be processed as soon as possible.
  7. ALESSIA FASHION GROUP SRL may not accept and process orders if there are not sufficient guarantees of payment solvency, if orders are incomplete or incorrect, or if products are no longer available. If the products subject to the order are not available due to reasons beyond the control of ALESSIA FASHION GROUP SRL, the order will be automatically adjusted by removing the unavailable product.
  8. The product availability indicated on the site refers to the actual availability at the time the Customer places the order. However, this availability should be considered indicative because, due to the simultaneous presence of multiple users on the site, products may be sold to other customers before the order is confirmed.
  9. Customers accessing the localized site may have access to products available and purchasable in the country of site localization. Purchased products can only be delivered within the territory of the country of site localization.
  10. In the event that ALESSIA FASHION GROUP SRL is unable to fully accept the order received from the Customer, opting for a partial acceptance regarding available products, any exercise of the right of withdrawal will occur without any charge for shipping costs to the Customer.
  11. By sending the order to ALESSIA FASHION GROUP SRL, the Customer consents to and accepts these online general terms and conditions of sale, as well as additional conditions on the Site through links, including the online general terms and conditions of sale, the Privacy Policy, and the return terms.
  12. The language in which the contract is concluded is Italian. In case of conflict between the versions of the General Terms prepared in a language other than Italian and accepted by the customer, the meaning and interpretation of the General Terms in the Italian language prevail.

PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER PURSUANT TO ART. 49 OF D.LGS 206/2005

Before concluding the purchase contract, the Customer reviews the characteristics of the goods illustrated in the individual product sheets at the time of selection. Before concluding the purchase contract and before sending the order, the Customer is informed about:

  • Seller identification;
  • Total price of the goods, including taxes, with details of shipping costs and any other costs;
  • Payment methods;
  • Conditions, terms, and procedures for exercising the right of withdrawal.

PRICES AND PAYMENT METHODS

  1. All product prices on the Site are expressed in Euro (€), inclusive of taxes, VAT, and shipping in Italy, including islands; however, any customs duties for shipments abroad are the responsibility of the Customer. Prices displayed, until order confirmation, are subject to change. The Customer is required to check the final sales price before submitting the order proposal.
  2. Payment can be made through the following methods:
    - Paypal circuit;
    - Credit card;
    - Bank transfer (only for European Union countries). 
  3. At no time during the payment process will ALESSIA FASHION GROUP SRL have access to the Customer's credit card information, transmitted via a secure connection directly to the bank's website handling the transaction. No computer archive of ALESSIA FASHION GROUP SRL will retain such data, and therefore, ALESSIA FASHION GROUP SRL cannot be held responsible for any fraudulent and unauthorized use of credit cards by third parties during payment.
  4. In the case of payment by debit/credit card or PayPal, all related details (e.g., card number or expiration date) will be handled directly by the managers of these online payment methods, without third parties having access to them. These details will not be used directly by ALESSIA FASHION GROUP SRL, except those necessary for payment confirmation. The price for the purchase of products and related delivery charges, as indicated in the order confirmation, will be charged to the credit/debit card or PayPal simultaneously with the order confirmation. No additional charges will be incurred by ALESSIA FASHION GROUP SRL for credit card payments.
  5. In the case of payment by bank transfer, bank details for payment will be displayed. The shipment of goods will only take place upon the actual receipt of payment in the bank.
  6. For each order placed after January 1, 2021, the system may ask you to authenticate your payment through the 3D Secure process, which will be customized based on the type of card used for payment.
  7. If, for any reason, it is not possible to debit the due amount, the sales process will be automatically canceled, and the sale will be resolved. The Customer will be informed through appropriate automatic email communication.
  8. For each order placed on the Site, at the time of payment, ALESSIA FASHION GROUP SRL will issue a tax receipt for the shipped goods.

SHIPPING

  1. ALESSIA FASHION GROUP SRL undertakes to deliver the products via courier to the address provided by the Customer at the time of the order within a maximum of 10 days from the date the Customer receives the order confirmation email.
  2. ALESSIA FASHION GROUP SRL reserves the right to accept or reject requests outside Italian or European borders. In any case, for deliveries outside Italian borders, shipping costs will be calculated separately, and delivery times may be longer.
  3. For deliveries to countries outside the European Union, any customs import duties will be the responsibility of the recipient. Therefore, the Customer is advised to contact the customs authorities of their own country in advance to verify the costs and any import limitations.
  4. The indicated delivery times should be considered purely indicative, and any delay in them or the possible delivery made through subsequent partial shipments does not entitle the Customer to refuse the delivery or request compensation or indemnity.
  5. Any courier strikes are beyond our competence and responsibility.
  6. Notwithstanding the above, the execution of the purchase order will take place by delivering the products within thirty (30) days from the date of conclusion of the contract, in accordance with Article 61 of the Consumer Code.
  7. The purchased goods will be delivered to the address provided by the Customer at the time of purchase. Unless excluded by the sales conditions or within specified limits, the Customer may provide an address for the delivery of the goods other than their residence or domicile.

RESERVATION OR REFUSAL UPON DELIVERY

Any reservations made by the Buyer at the time of receiving the products regarding damage to the products or packaging, or quantitative differences, must be communicated to the Seller within the first working day following delivery. The weight measured by the Seller at the shipping points is valid unless there is a manifest error. If the Buyer does not accept the goods in accordance with the delivery terms specified by the Seller, the products may, at the Seller's sole discretion, be transported and stored at the expense and responsibility of the Buyer in other locations identified by the Seller, who hereby disclaims any responsibility in this regard. This provision does not modify the payment obligations of the Buyer and does not constitute any novation of the sale.

RIGHT OF WITHDRAWAL AND REFUND

  1. Internet sales of products are governed by Articles 45 to 67 of D.Lgs 206/2005 (Consumer Code).
  2. The consumer has a period of 14 (fourteen) days to withdraw from a distance or off-premises contract. This legislation grants the consumer the right to withdraw from contracts or contract proposals, allowing them to return the purchased product and obtain a refund of the incurred expenses. The right of withdrawal does not apply to opened sealed products, nor to sealed goods that are not suitable for return for reasons of hygiene or health and have been opened after delivery. The right of withdrawal can be applied to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product.
  3. To exercise the right of withdrawal, the Customer must send a communication to info@alessiafashion.com within the specified time frame.
  4. In the case of withdrawal, the Customer must return, at their own expense, the products to ALESSIA FASHION GROUP SRL within 14 (fourteen) days of the withdrawal, to the following address: VIA AVELLINO, 11 TORINO.
  5. The products must be returned intact, complete with all parts, and in the original packaging (bags, boxes, and packaging), possibly used only for the time strictly necessary to establish and verify their nature, characteristics, and size, according to normal diligence.
  6. The Customer is responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the products, namely:
    - in the absence of the original packaging;
    - in the absence of integral elements of the product (accessories, complements, etc.);
  7. This decrease will be quantified at the time of the product's return and may vary from a minimum of 5% to a maximum of 25% of the value at which the goods were purchased by the Customer.
  8. For the withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, labels, tags, seals, etc.);
  9. If a product has a security tag, the item must be returned with the tag in its original position.
  10. In any case, the Customer will forfeit the right of withdrawal in cases where ALESSIA FASHION GROUP SRL determines that:
    - the returned product and/or its accessories, and/or its packaging are not intact;
    - the product is missing its external packaging and/or original internal packaging;
    - the product is missing integral elements and/or accessories.
  11. ALESSIA FASHION GROUP SRL will not be responsible in any way for damage, theft, loss occurring during or as a result of the return shipment.
  12. The right of withdrawal is reserved exclusively for consumers (individuals who purchase goods not for purposes related to their professional, commercial, or entrepreneurial activity), therefore it cannot be exercised by legal entities and individuals acting for purposes related to any professional activity.
  13. The costs of returning the product (and any customs fees, if applicable) are borne by the Customer.
  14. The shipment, until the certificate of receipt by ALESSIA FASHION GROUP SRL, is under the complete responsibility of the Customer.
  15. ALESSIA FASHION GROUP SRL will refund the Customer the entire amount already paid, net of any additional shipping costs under Article 56, paragraph 2, of D.Lgs 21/14, within 14 (fourteen) days of withdrawal. In any case, the Customer will not incur any costs as a result of said refund except for the shipping costs (and any customs fees, if applicable) for the return of the goods, which will remain the exclusive responsibility of the Customer.
  16. If the recipient of the products specified in the order is different from the entity that made the payment for these products, the amount paid corresponding to the returned items will be refunded by ALESSIA FASHION GROUP SRL to the payer.
  17. However, ALESSIA FASHION GROUP SRL reserves the right to withhold the refund until it has received the goods for which the shipment was organized and carried out by the Customer, or until the Customer has demonstrated that they have returned the goods, depending on which situation occurs first.
  18. In the event of forfeiture of the right of withdrawal, ALESSIA FASHION GROUP SRL will return the purchased product to the sender, charging them for the shipping costs, and, if already reimbursed, the price of the product.

LEGAL WARRANTY

  1. All products presenting defects/malfunctions existing at the time of purchase or occurring within two years are covered by the warranty offered by the seller ("Legal Warranty").
  2. The warranty period starts on the date of product receipt, and the customer is therefore encouraged to keep a copy of the transport document issued at the time of delivery along with the purchase invoice.
  3. In the event of non-compliance, the Consumer who has reported it to the Seller within the specified terms, namely within 60 days of discovering the defect, is primarily entitled to repair or replacement of the goods. Alternatively, the Consumer may request a price reduction or contract resolution secondarily.
  4. The repair will be carried out as quickly as possible, and except in exceptional cases, the repair will be completed within 60 days. In case of unjustified exceeding of this deadline, the Consumer may request replacement of the goods or contract resolution. 

LIABILITY AND FORCE MAJEURE

  1. ALESSIA FASHION GROUP SRL assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet network, in case it is unable to execute the order within the times specified by these General Terms and Conditions.
  2. In both the case of exercising the right of withdrawal and the case of exercising the right to conformity warranty, if the goods cannot be accepted by the seller because they do not meet the requirements to exercise the preceding rights, it is the responsibility and obligation of the Customer to retrieve the goods at their own expense. The Customer acknowledges and unconditionally accepts that ALESSIA FASHION GROUP SRL, after 30 days from the communication of the availability to the Customer, may proceed with the disposal of the goods not retrieved by the Customer in accordance with the law.
  3. Notwithstanding what has been previously regulated, any delays in delivery not dependent on the will of the Seller, such as, for example, strikes, fires, picketing, production blockages, insurrections, and other situations beyond the Seller's control, will not entitle the Buyer to cancel orders or resolve the contract, nor to any compensation in favor of the Buyer, without prejudice to the effects of such delays on the sole expiration of payment terms. The Seller reserves the right to cancel the order in any case.

APPLICABLE LAW AND JURISDICTION

For all matters not expressly regulated by these General Conditions, Italian law shall apply, and for any dispute arising in relation to the interpretation and execution of the sales contract, the exclusive jurisdiction of the Milan Court is hereby acknowledged.

PRIVACY POLICY pursuant to Article 13 of EU Regulation 2016/679 on the protection of personal data (hereinafter also "GDPR").

Purpose of processing

With the Consumer's consent, personal data will be processed for the following purposes:

  1. Website Registration
    The Customer can choose to register on the website by creating a password-protected account with their personal data. By registering on the site, with the Consumer's consent, ALESSIA FASHION GROUP SRL will process their data so that they can avail themselves of certain services, such as viewing the data of current and recently processed orders. Registration also allows the management of consents given for newsletter subscription and profiling.
  2. Management of the contractual relationship
    If the Customer purchases products on our website, certain common personal data (name, surname, address, email, payment information) will be required for the execution of the purchase order. ALESSIA FASHION GROUP SRL collects and processes this data for the complete execution of the purchase, including subsequent warranty procedures and technical and commercial administration services, as well as to prevent crimes and fraud. Personal data is transmitted to third parties only to the extent permitted by law, including for the purposes of contract execution or billing. In the course of order processing, service providers we engage (e.g., carriers, logistics companies, banks) receive the necessary data to fulfill the order and the task. Service providers we engage can only use the transmitted data for the purpose of fulfilling their task.
  3. Direct Marketing
    Personal data provided on the newsletter subscription and website registration pages will be used for the following purposes: collection, recording, and processing of purchase data, sending advertising/informative/promotional material, promotional operations, and offers from EPIQUE.
  4. Customer Care
    In case the Customer wants to request any information through the "contacts" section of the website, whether in writing or by calling the indicated phone number, some personal data will be required for the management of the request, some of which (name, surname, and email address) are mandatory. Consent to the processing of this data will allow us to process their requests. No other use of the data will be made except for the management of the submitted request.

Legal basis for processing

The legal basis for processing for the purposes mentioned above is based on the Consumer's consent to the processing of their personal data. Nevertheless, processing may also occur as necessary for the performance of a contract to which the Consumer is a party or for the execution of pre-contractual measures adopted at their request, to comply with legal obligations to which the data controller is subject, or in cases where the processing is lawful under Article 6 of the GDPR and subsequent amendments and integrations, also introduced by the State.

Methods of use

ALESSIA FASHION GROUP SRL aims to protect the Consumer's personal data and bases their processing on the principles of fairness, lawfulness, and transparency. Therefore, we inform you that personal data will be processed using tools and procedures suitable to ensure security and confidentiality, through computer and telematic means as well as through paper supports and archives.

Retention periods

ALESSIA FASHION GROUP SRL will retain personal data for different periods, depending on the purposes for which they were collected:

  • If the Customer has an account, we will retain their personal data as long as the account remains active;
  • If the Customer has subscribed to the newsletter service, we will retain their data until they communicate their intention to unsubscribe from the service.

Rights of the data subject under articles 15 and following of the GDPR

Furthermore, we inform the Consumer that they have the right to ask ALESSIA FASHION GROUP SRL to access their personal data and rectify them if inaccurate, delete them or limit their processing if the conditions are met, or object to their processing for legitimate interests pursued by the Company, as well as to obtain the portability of the data provided, only if subject to automated processing based on consent or contract. The Customer also has the right to revoke the consent given for processing purposes that require it, without affecting the lawfulness of the processing carried out until the revocation. We inform you that the Consumer can exercise their rights by contacting the Data Controller at the contact details indicated in point 1. Furthermore, the Consumer has the right to lodge a complaint with the Data Protection Authority (www.garanteprivacy.it).

Age Requirement

This information is addressed exclusively to individuals who have reached the legal age. Therefore, if a person is a minor, they are kindly requested to refrain from providing their data and giving consent to processing, as their data will not be collected, stored, or processed by the Data Controller for any of the aforementioned purposes.

Any reproduction, modification, distribution, transmission, publication, and, in general, any use, even if not expressly mentioned, of the intellectual property rights of ALESSIA FASHION GROUP SRL will be prosecuted under the terms of the law.

FINAL CLAUSES

  1. ALESSIA FASHION GROUP SRL reserves the right to modify these general terms and conditions of sale at any time, at its discretion, without the need to provide any notice to the website users. Any changes made will be effective from the date of publication on the website and will apply only to sales concluded from that date onwards. 
  2. Prices, products for sale on the website, and their characteristics are subject to change without notice.
  3. These General Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Conditions of Sale are deemed invalid or declared as such under the law, regulations, or by a decision of a court having jurisdiction, the other provisions will continue to have full force and effect.
  4. The terms and general conditions of online sales may be updated to comply with new laws and regulations or for other reasons. The new terms and general conditions of sale will be effective from the date of publication on www.epique.it.
  5. ALESSIA FASHION GROUP SRL reserves the right to modify, limit, or cease the extent and functionality of the website at any time. While it is always the Seller's intention to provide the service without technical malfunctions, its use may be suspended at any time due to maintenance work, new developments, and/or other obstacles. This may potentially result in data loss. Therefore, ALESSIA FASHION GROUP SRL assumes no responsibility for the availability of the service, the absence of technical malfunctions, or data loss.
